OSHA may hold an informal conference for the purpose of discussing any issues raised by an inspection, citation, or notice of proposed penalty. Area Directors at OSHA are authorized to change abatement dates, to reclassify violations (e.g., willful to serious, serious to other-than-serious), and to modify or withdraw a penalty, a citation or cited items if the employer presents evidence during the informal conference which convinces the Area Director that the changes are justified


U.S. Safety can represent the employer by creating a safety management system prior to the conference. At the conference U.S. Safety would discuss the proposed safety management program to evidence the employer’s willingness and commitment to resolve any issues cited by OSHA. This would also demonstrate that an on-going Safety Program would ensure that the employer would be less likely to have future safety issues on the job site.


U.S. Safety has had many years of success mediating between our clients and OSHA to substantially reduce penalties incurred. As much as a 65% reduction has been negotiated.
